1. About Mellow

These terms apply to purchases from our online store and use of our website. Please read them alongside our Return and Refund Policy and Privacy Policy. Nothing in these terms excludes or restricts rights you have under mandatory consumer law.
2. Orders and payment
Please provide accurate contact and delivery details and use a payment method you are authorised to use. You must have legal capacity to enter into a purchase contract. You can review your order and the total price before submitting it.
An order acknowledgement confirms receipt of your order. We accept your order when we confirm acceptance or dispatch the goods, whichever happens first. If an item is unavailable or we cannot accept your order, we will notify you and promptly refund any payment taken for it. We will not substitute a product or increase an agreed price without your consent.
If you notice an error in your order, contact us as soon as possible. Dispatch does not remove any statutory right to cancel or return goods.
3. Products and safe use
We aim to describe products accurately. Screen settings can affect how colours appear, but this does not affect your right to receive goods that match their description, are of satisfactory quality and are fit for their stated purpose.
Please read the product label, ingredients, directions and warnings before use. Individual experiences with cosmetics vary. Our skincare information is general product information and is not a medical diagnosis or treatment recommendation. This does not limit our responsibility for product safety or the accuracy of product descriptions.
4. Prices and delivery charges
The currency and price applicable to your order are displayed in the store and at checkout. Applicable taxes and delivery charges must be disclosed before you place your order. For consumers in the UK or EU, prices include VAT where required by law. Any additional charges payable by you must be disclosed before purchase; these terms do not authorise undisclosed fees.
Promotions apply according to the conditions displayed with the offer. Price changes apply to future orders and do not change an accepted order. If we discover an obvious pricing error before acceptance, we will contact you so you can choose whether to proceed at the correct price or receive a refund.
5. Delivery
Delivery availability, charges and any delivery estimate shown before purchase form part of your order information. We are responsible for delivering the goods in accordance with the agreed arrangements. Where mandatory law sets a delivery deadline, that deadline applies. Delays do not remove your statutory remedies.
For UK and EU consumer orders, risk of loss or damage remains with us until you, or a person you nominate, takes physical possession, except where you independently appoint a carrier not offered by us and the law provides otherwise. Contact us if an order is delayed, missing or damaged.
6. Returns, cancellation and faulty goods
Our Return and Refund Policy explains our additional 30-day return policy and applicable UK/EU cancellation rights. Statutory rights concerning faulty, damaged or misdescribed goods remain available independently of our voluntary return policy. A sale or promotional price does not remove those rights.
7. Website use and intellectual property
Use the website lawfully. Do not interfere with its security, introduce malicious software, impersonate others or misuse personal information. Website materials belong to their respective owners. You may use the site for personal shopping and keep copies of information relating to your orders; other reproduction requires permission unless permitted by law.
8. Shopify and third-party services
Our store is hosted by Shopify. Your purchase contract is with Livefash B.V., trading as Mellow, rather than Shopify. Third-party websites and services may have their own terms and privacy notices. Their involvement does not remove our responsibilities as the seller or any rights that cannot lawfully be excluded.
9. Privacy
Our Privacy Policy explains how personal information is processed and how to exercise your privacy rights. Using the store does not itself constitute consent to optional marketing or non-essential cookies where separate consent is required.
10. Responsibility and consumer rights
We are responsible for loss or damage to the extent required by applicable law. Nothing in these terms excludes liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, defective products where liability cannot be excluded, or any other liability that cannot lawfully be limited.
You retain the mandatory protections and access to courts available under the law applicable to your consumer contract, including protections in your country of habitual residence where applicable. These terms do not require you to give up those protections or bring a claim exclusively in another country.
11. Complaints and updates
Please send questions or complaints to info@mellowskin.co, including your order number where relevant. We will investigate and work with you to resolve the issue. This does not prevent you from using any legal remedy or contacting a competent consumer authority.
We may update these terms for future purchases. The version applicable when your order was placed continues to govern that order unless a change is required by law or agreed with you. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
